End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Molls and Hersh, LLC ("Work Tunnel", "we", "us") governing your use of the downloadable Work Tunnel software — including the Work Tunnel Agent, the command-line interface, and the Windows Session Host (together, the "Software"). Your use of the Work Tunnel website and relay service is governed separately by our Terms of Service; this EULA covers the Software you install on your own devices.
By downloading, installing, or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.
1. License grant
Subject to your compliance with this EULA, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Software on devices you own or control, solely for your personal use or your own internal business use, and solely in connection with your Work Tunnel account.
2. License restrictions
You may not, and may not permit anyone else to:
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent this restriction is prohibited by applicable law;
- copy, redistribute, sell, rent, lease, sublicense, or otherwise make the Software available to any third party;
- modify, adapt, or create derivative works of the Software, except as expressly permitted;
- remove, alter, or obscure any proprietary notices in the Software; or
- use the Software to build a competing product, or in any manner not expressly permitted by this EULA.
3. Account-tied license
The Software works together with your Work Tunnel account. This license is tied to your account and terminates automatically when your account is closed or terminated, or upon your breach of this EULA. On termination you must stop using and uninstall the Software.
4. Automatic updates
The Software may download and install updates automatically to maintain security and compatibility. You consent to these automatic updates as part of using the Software.
5. Ownership
The Software is licensed, not sold. We and our licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted except those expressly set out in this EULA.
6. Third-party and open-source components
The Software may include third-party or open-source components licensed under their own terms; those terms govern your use of those components and, where required, are provided with the Software.
7. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORK TUNNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO THE SOFTWARE. OUR TOTAL LIABILITY UNDER THIS EULA WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50. This limitation is consistent with the limitation of liability in our Terms of Service.
9. Export compliance
You agree to comply with all applicable export-control and sanctions laws and not to use or export the Software in violation of them.
10. Termination
This EULA is effective until terminated. It terminates automatically if you breach it or when your Work Tunnel account ends. Provisions that by their nature should survive — including ownership, disclaimers, and limitation of liability — survive termination.
11. Governing law
This EULA is governed by the same laws that govern our Terms of Service, without regard to conflict-of-laws rules.
